San Andreas Marshal Act 2024

Preamble: To ensure the safety, security, and welfare of the citizens of San Andreas, this Act establishes the San Andreas Marshal Service (SAMS) as a law enforcement agency responsible for upholding justice, enforcing state and federal laws, and assisting local agencies in critical operations.


Section 1: Title and Definitions

1.1 Title: This legislation shall be known as the "San Andreas Marshal Act."

1.2 Definitions:

  • Marshal Service: Refers to the San Andreas Marshal Service (SAMS).

  • Marshal: An officer employed by the SAMS.

  • State Jurisdiction: Includes all counties, municipalities, and unincorporated areas within the State of San Andreas.

  • Lawful Authority: Any legal power granted under the Constitution or statutes of San Andreas.


Section 2: Establishment and Purpose

2.1 Creation of the SAMS: The San Andreas Marshal Service is hereby established as a statewide law enforcement agency.

2.2 Mission: The SAMS shall:

  • Enforce state and federal laws.

  • Apprehend fugitives.

  • Provide witness protection services.

  • Assist in the execution of court orders.

  • Conduct investigations related to inter-county crimes.

  • Support local law enforcement during critical incidents and emergencies.


Section 3: Organizational Structure

3.1 Director of SAMS: The SAMS shall be headed by a Director appointed by the Attorney General of San Andreas, subject to legislative approval.

3.2 Deputy Directors: The Director shall appoint Deputy Directors to oversee divisions, including Operations, Investigations, and Administrative Services.

3.3 Regional Offices: The SAMS shall establish regional offices to ensure coverage across San Andreas.

3.4 Chain of Command: The chain of command shall flow from the Director to the Deputy Directors, Regional Commanders, and Marshals.


Section 4: Powers and Duties

4.1 Jurisdiction: The SAMS shall have jurisdiction throughout the State of San Andreas.

4.2 Duties of Marshals:

  • Execute warrants and court orders.

  • Transport detainees and secure court facilities.

  • Investigate and apprehend individuals involved in interstate and inter-county criminal activities.

  • Provide assistance during emergencies, including natural disasters and public unrest.

4.3 Coordination with Local Agencies: The SAMS shall collaborate with local law enforcement agencies and provide mutual aid when requested.

4.4 Special Assignments: The Attorney General or Director may assign specific tasks to the SAMS, including high-profile criminal investigations or state-level security operations.


Section 5: Authority and Use of Force

5.1 Lawful Authority: Marshals are authorized to:

  • Carry firearms and use necessary force in the performance of their duties.

  • Detain individuals suspected of committing crimes within their jurisdiction.

  • Conduct searches and seizures in accordance with the law.

5.2 Accountability: The SAMS shall establish protocols to ensure the use of force is proportional, justified, and subject to review.


Section 6: Training and Standards

6.1 Training Requirements: All Marshals must complete a state-approved training academy and pass certification exams.

6.2 Professional Standards: The SAMS shall maintain a Code of Conduct for all personnel and ensure compliance through regular evaluations and oversight.


Section 7: Funding and Resources

7.1 Budget Allocation: The SAMS shall receive funding from the state budget as approved by the Legislature.

7.2 Grants and Partnerships: The SAMS may seek federal grants and enter into partnerships to enhance resources and operational capabilities.


Section 8: Oversight and Accountability

8.1 Inspector General: An Inspector General shall oversee the SAMS to ensure transparency and accountability.

8.2 Public Reporting: The SAMS shall submit an annual report detailing activities, expenditures, and performance metrics to the Governor and Legislature.

8.3 Complaints and Review: A public complaints process shall be established to investigate allegations of misconduct by Marshals.


Section 9: Implementation and Effective Date

9.1 Implementation: The Attorney General shall appoint the Director and allocate initial resources within 90 days of this Act’s passage.

9.2 Effective Date: This Act shall take effect immediately upon approval by the Legislature and signature by the Attorney General.


Section 10: Miscellaneous Provisions

10.1 Severability: If any provision of this Act is found to be unconstitutional or invalid, the remaining provisions shall remain in effect.

10.2 Amendments: This Act may be amended by a majority vote of the Legislature.
