Warrant - Possession of Government Issued Equipment/Items

Timeline for Enactment: Effective immediately 17/09/2024

When an individual(s) has been found in possession of Government issued items/equipment. The Police Department may request a Search Warrant to the Department of Justice for the individual(s) properties if they have been found in possession of the following;

  • PD Armor

  • iFax

  • Taser

  • Glock

Probable Cause:

  • If the Police Department has probable cause to believe that there are additional illegal firearms, contraband, or evidence of a crime in the person’s house, they may seek a search warrant. Probable cause could be established through the illegal firearm possession itself, especially if there is reason to believe it’s part of a larger criminal activity.

For example: if a Government Employee sees the individual in a Possession of Government Issued Items/Equipment and they see the Individual(s) enter their property, can indeed be a significant factor that justifies a house raid

Search Warrant

  • Law enforcement would need to obtain a search warrant from a judge before conducting a raid. The warrant would specify the location to be searched and the items they are seeking.

  • If officers conduct a raid legally and find further Government Issued Items/Equipment, the individual(s) will be charged according to the penal code and Stackable per individual Item

Legal Consequences:

  • Being found in possession of Government Issued Items/Equipment can lead to serious legal consequences, including arrest, charges, and the possibility of further investigation, such as a raid, depending on the context of the situation.

Therefore, Possession of Government Issued Items/Equipment can indeed be a significant factor that justifies a house raid, especially if there are other factors that support the need for a search. If you require any more information please reach out to the Department of Justice
