Possession of illegal Firearms
Until further notice the following is in place when it comes to individual/s are found in possession of an illegal firearm, it is possible that their house could be raided by law enforcement. The specifics can vary depending on the legal jurisdiction, but generally:
Probable Cause:
If the Police Department has probable cause to believe that there are additional illegal firearms, contraband, or evidence of a crime in the person’s house, they may seek a search warrant. Probable cause could be established through the illegal firearm possession itself, especially if there is reason to believe it’s part of a larger criminal activity.
Search Warrant
Law enforcement would need to obtain a search warrant from a judge before conducting a raid. The warrant would specify the location to be searched and the items they are seeking.
If officers conduct a raid legally and find illegal firearms, the evidence can be used in court to support criminal charges. However, if the raid is carried out without proper legal authority (e.g., no warrant or insufficient probable cause), any evidence collected might be challenged and potentially excluded from the case.
Legal Consequences:
Being found with an illegal firearm can lead to serious legal consequences, including arrest, charges, and the possibility of further investigation, such as a raid, depending on the context of the situation.
Therefore, possession of an illegal firearm can indeed be a significant factor that justifies a house raid, especially if there are other factors that support the need for a search. If you require any more information please reach out to me the Department of Justice
